At Erobimbo, we respect the intellectual property rights of others and expect our users to do the same. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our site, you may notify our Designated Copyright Agent as set forth in the Digital Millennium Copyright Act (DMCA). Upon receipt of a valid and complete notice, we will remove the content in question as required by the DMCA. This procedure is for reporting infringement of your copyright under Cyprus law.


DMCA Notice of Alleged Infringement ("Notice")

To file a notice of infringement with us, you must provide a written communication (by email: [email protected], with a subject line "DMCA Takedown Request") that sets forth the items specified below. Please note that you will be liable for damages (including costs and attorneys' fees) if you materially misrepresent that material is infringing your copyright(s). Thus, if you are not sure whether material available online infringes your copyright, we suggest that you first contact an attorney. To expedite our ability to process your request, please use the following format (including section numbers):


Identification of the work claimed to have been infringed

Describe the copyrighted work that you believe has been infringed. If multiple copyrighted works at a single online site are covered by a single notification, you may provide a representative list of such works.

Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material: Provide URLs leading directly to the specific content. If possible, include screenshots.

Information reasonably sufficient to permit the service provider to contact the complaining party: Include your full name, address, telephone number, and email address.

A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law:

A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed:

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed: You may type your full legal name to serve as your electronic signature at the end of your notice.

Counter-Notification Procedure

If you believe that the material that was removed or to which access was disabled is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notice containing the following information to the Designated Copyright Agent at the address listed above:

Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled:

A statement that you consent to the jurisdiction of the court for the judicial district in which your address is located, or if your address is outside of the Cyprus, for any judicial district in which the service provider may be found:

A statement that you will accept service of process from the party that filed the Notice or the party's agent:

A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled:

Upon receipt of a counter-notice, Erobimbo will forward it to the original complaining party. The complaining party has 10 business days to file a lawsuit seeking a court order to prevent further infringement of the material. If the complaining party does not take such action, Erobimbo may restore the material to the site.


Repeat Infringers

In accordance with the DMCA and other applicable law, Erobimbo has adopted a policy of terminating, in appropriate circumstances and at Erobimbo's sole discretion, users who are deemed to be repeat infringers. Erobimbo may also at its sole discretion limit access to the Site and/or terminate the memberships of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
